With the DDO regime well into its second year, ASIC’s recent media release 23-115MR makes it clear we are entering a period of enforcement and ASIC is expecting product issuers to “lift their game”. The ability to issue stop orders for target market determinations that ASIC consider to be deficient provides an effective tool to ensure product issuers are meeting their expectations.
