With the DDO regime well into its second year, ASIC’s recent media release 23-115MR makes it clear we are entering a period of enforcement and ASIC is expecting product issuers to “lift their game”. The ability to issue stop orders for target market determinations that ASIC consider to be deficient provides an effective tool to ensure product issuers are meeting their expectations.

In light of ASIC’s risk-based review revealing product issuers are deficient in meeting the DDO, this tailored workshop, facilitated by Nathan Hodge, Partner, King & Wood Mallesons, and Sarah Yu, Partner, King & Wood Mallesons, will help trustees identify potential gaps in compliance, provide actionable guidance and equip attendees with the tools and knowledge they need to improve their DDO compliance processes.

Don’t miss this opportunity to “lift your game” on the DDO obligations, and better manage risks.

Key topics to be discussed include:

  • Overview of the design and distribution obligations
  • Common trends in target market determinations issued by super trustees
  • ASIC’s expectations of product issuers under DDO
  • When has ASIC issued stop orders under the DDO regime and why
  • Identifying and addressing gaps in target market determinations
  • Thinking about upgrading distribution and oversight arrangements
  • Best practice in monitoring and review.

Who should attend?

  • CEOs, and senior management staff
  • Governance
  • Compliance and risk professionals
  • Product managers
