1 Jan 2012 SuperStream Funds can use TFNs to search the ATO’s superannuation registers (currently only lost accounts, unclaimed SG and SHAR payments and unclaimed monies). Funds can use TFNs to seek account information from another fund or RSA.

(NB: ATO and other fund searches both require member consent to the use of the TFN.)

Treasury releases draft regulations to require:

  • trustees of SMSFs to consider insurance for their members as part of the fund’s investment strategy;
  • money and other assets of an SMSF be kept separate from money and assets held by a trustee personally and by a standard employer-sponsor or an associate of a standard employer sponsor; and
  • SMSFs to value the assets of the fund at net market value for reporting purposes.

Jul 2012 SMSF

The Government has announced delayed starting dates for a number of SMSF reforms. Full details are available on the Stronger Super website here.

In summary the following implementation dates have been delayed:

  • The introduction of a new range of administrative penalties (1 July 2013)
  • Powers to require specific contraventions to be rectified (1 July 2013)
  • Mandatory trustee education (1 July 2013)
  • The acquisition and disposal of assets between SMSFs and related parties (1 July 2013)
  • Criminal and civil sanctions to enable the ATO to penalise and discourage illegal early release scheme promoters (on Royal Assent)
  • Amendments to existing tax laws so that amounts illegally released early are taxed at the superannuation non-complying tax rate (1 July 2013)

Jul 2012 SuperStream New ATO online facility available for members to view their active accounts (those reported on the MCS), their lost accounts and other superannuation monies held by the ATO. Funds must have member consent to search the account information, using the member’s TFN.
1 Jul 2012 FoFA

Commencement date for the majority of the FoFA reforms, including the prospective ban on conflicted remuneration structures, adviser charging regime and statutory best interests duty. However, the Government announced a “soft regulatory” approach to the implementation of FoFA in the first 12 months.

Exposure draft legislation released by Treasury regarding –

Administrative consequences and Penalties for Trustees of SMSFs
This measure will provide the Commissioner of Taxation (Commissioner) with additional tools and more flexibility to deal with non-compliance with the law. These new tools will be available in conjunction with the Commissioner's existing powers to regulate the SMSF sector.

Penalties for Promoters of Illegal Early Release Schemes
This measure will deter promoters of illegal early release schemes from undermining the Government’s retirement policy and harming members in the process.

Roll-overs to SMSFs
As part of this measure, roll-overs to SMSFs will be captured as a designated service under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.

First tranche of MySuper – Superannuation Legislation Amendment (MySuper Core Provisions) Bill 2011 – passed the House of Representatives with amendments successfully moved by the Government and the Greens.

APRA's enhanced data collection consultation paper is released. The discussion paper outlines APRA’s proposed revised reporting requirements for APRA-regulated superannuation funds. The consultation package includes 31 draft reporting forms and instructions.

Superannuation Laws Amendment (Capital Gains Tax Relief and Other Efficiency Measures) Bill 2012 tabled in Parliament. The Bill –

  • Provides CGT relief for funds that merge in response to the Stronger Super reforms
  • Introduces a registration regime for SMSF auditors
  • Expands the existing reporting obligation for superannuation providers
  • Amends the SIS Act, and the Retirement Savings Accounts Act 1997, to improve the quality of information in the superannuation system and to facilitate fully effective e-commerce
19 Sep 2012 SMSF The Superannuation Auditor Registration Imposition Bill 2012 tabled in Parliament. The Bill provides for the imposition of fees relating to approved auditors of SMSFs.
19 Sep 2012 MySuper Tranche Three – Superannuation Legislation Amendment (Further MySuper and Transparency Measures) Bill 2012 tabled in Parliament.

ASIC released Consultation Paper 189 Future of Financial Advice: Conflicted remuneration

It outlines the ban on conflicted remuneration includes commissions and volume-based payments in relation to the distribution of and advice about retail investment products.

Oct 2012 SuperStream ATO proposes requiring all funds to report on their 2011/12 MCS details of all accounts held by persons aged 48 and older. (The data is required to administer the new contribution rules for those over age 50.)

A further tranche of FoFA regulations were registered. Corporations Amendment Regulation 2012 (No. 8) implements grandfathering arrangements for payments made by platform operators with respect to the ban on conflicted remuneration.

Exposure Draft – Accountants' exemption replacement regulations

Under the proposed arrangements, accountants will be able to access a new form of limited licence from 1 July 2013 which will enable them to discuss a range of financial products with their clients. The range of products includes SMSFs, superannuation, securities, simple managed investment schemes, general insurance, life risk insurance and basic deposit products.

Income Tax Rates Amendment (Unlawful Payments from Regulated Superannuation Funds) Bill

Tabled in Parliament. The bill imposes the superannuation fund non-complying tax rate of 45% on those amounts that are released early from superannuation by illegal means.

Superannuation Legislation Amendment (Reducing Illegal Early Release and Other Measures) Bill 2012

Tabled in Parliament. This bill introduces civil and criminal sanctions for a person who promotes a scheme that has resulted, or is likely to result, in the illegal early release of superannuation benefits.

MySuper Tranche 4 Superannuation Legislation Amendment (Service Providers and Other Governance Measures) Bill 2012

Tabled in Parliament. The bill was subsequently referred to the PJC on Corporations and Financial Services – submissions due 17th January for report 4th February.

The bill:

  • Overrides any provisions in a fund’s governing rules that stipulate that the trustee must use a specific service provider or only invest through in or through specified entities
  • Provides powers to APRA to issue infringement notices as an alternative to criminal prosecution
  • Provide a requirement on trustees to give reasons for decisions
  • Provides more time for members and beneficiaries to lodge complaints with the SCT
  • Enhances requirement for dual regulated entities
  • Makes some amendments to Trance 2 re director liability

  • Prudential Practice Guide SPG 232 Business Continuity Management;

  • Prudential Practice Guide SPG 520 Fit and Proper;
  • Prudential Practice Guide SPG 521 Conflicts of Interest;

Exposure draft of legislation relating to acquisitions and disposals of certain assets between self-managed superannuation funds (SMSFs) and related parties as well as the accompanying explanatory material.

1 Jan 2013 MySuper Applications for MySuper can be lodged from 1 January 2013.
1 Jan 2013 SuperStream

Intra-fund consolidation of accounts. Where a member has multiple accounts within a fund, funds would be required to identify and consolidate these accounts, where possible.

Proposed that:

  • By 1 January 2013 trustees must have appropriate processes and protocols established.
  • By 30 June 2014 all multiple accounts to be identified, a decision made as to whether or not to consolidate and any consolidation process to be completed.

13 Feb 2013 SMSF Superannuation Legislation Amendment (Reform of Self-Managed Superannuation Funds Supervisory Levy Arrangements) Bill 2013 tabled in Parliament. The Bill increases the maximum levy payable by a trustee of a self-managed superannuation fund for an income year from $200 to $300, effective from the 2013-14 financial year.

27 Feb 2013 FoFA The Government announces that the replacement of the accountants' licensing exemption with a limited Australian Financial Services License (AFSL) will be finalised by way of regulations in April, 2013.

The regulations clarifies MySuper requirements regarding significant event notices, provision of insurance and the transfer of default amounts to a MySuper product in another fund.

15 Mar 2013 SuperStream ATO and APRA jointly write to RSEs re new obligations relating to the implementation of the new Data and Payment Standards.
20 Mar 2013 SuperStream Tax and Superannuation Laws Amendment (2013 Measures No. 2) Bill 2013 is tabled in Parliament and referred to the House Standing Committee on Economics on 21 March 2013. The Bill requires trustees to implement intra-fund consolidation of accounts.

Of note the Bill proposes to extend by 12 months, to 30 June 2014, the date by which all multiple accounts are to be identified, decisions made as to whether or not to consolidate and any consolidation process is completed.
22 Mar 2013 MySuper Tranche 4 of the MySuper legislation Superannuation Legislation Amendment (Service Providers and Other Governance Measures) Bill 2012 is not passed in the Autumn sittings of Parliament.

From their transition-in completion date, APRA‑regulated funds must use the new standard for sending rollovers.

The revised implementation date for the following reforms:

  • Amendments to the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 to capture rollovers to an SMSF as a designated service.
  • The introduction of a new range of administrative penalties.
  • Powers to require specific contraventions to be rectified.
  • Mandatory trustee education.
  • The acquisition and disposal of assets between SMSFs and related parties.
  • Amendments to existing tax laws so that amounts illegally released early are taxed at the superannuation non-complying tax rate.

Oct 2013 SuperStream MCS reporting for 2012/13 and later years will include all accounts held by the fund (i.e. inactive accounts, lost accounts, active accounts and pension accounts).

From the later of Monday 6 Oct and their transition-in end date, funds must send Initiate-Rollover requests in conformance with the Data Standards.
2014
Jan 2014 SuperStream Commencement of auto‑consolidation of accounts on the LMR and accounts that have not received a contribution or rollover in the previous two years and where the account balance is less than $1,000.

Data standards and use of e-commerce becomes mandatory for large and medium employers (20 or more employees) making contributions and enrolling new members in default funds. From this date all APRA-regulated funds must be able to receive contributions in the new format and SMSFs must be able to receive contributions in the new format where the employer is non-associated.
Jul 2014 SMSF Final changes to the SMSF registration process linking the registration process with proof of identity checks, bank account details and a portal to ATO data for verification of details by APRA funds requested to make rollovers to an SMSF.
14 Jul 2014 MySuper Full suite of APRA reports required for MySuper and choice options.
Jul – Dec 2014 SuperStream A new process will be introduced to ensure new employees consider account consolidation at the time of beginning new employment. Employees will be able to access from the ATO online a listing of all their superannuation accounts.  The employee can use this information and elect to have contributions made to their existing account or open a new default account and also to initiate account consolidation to their active fund. The member’s active fund will facilitate the consolidation. Effectively ATO online will become a central portal to provide information on members’ superannuation accounts and help them consider and facilitate account consolidation.
2015
Jul 2015 SuperStream Data standards and use of e-commerce become mandatory for small employers (fewer than 20 employees) making contributions and enrolling new members in default funds.
2016
Jul 2016 SMSF End of transitional period for when investments in collectables and personal use assets held at 30 June 2011 need to comply with new legislative standards introduced in 2011.
2017
1 Jul 2017 MySuper Trustees of superannuation funds offering MySuper products will need to transfer the existing balances of default members to a MySuper product.
