2011
27 Jun 2011 Legislation passes that applies to all new investments in collectables and personal use assets. All existing investments of this kind need to comply with new standards by 1 July 2016. Access the law here.
The ATO has also issued guidance on SMSFs investing in collectibles.
8 Dec 2011 The ATO issues Q&A for SMSFs investing in collectibles and personal use assets. Access the ATO Q&A here.
2012
2 Mar 2012 ASFA lodges submission regarding draft ATO Valuation Guidelines for SMSFs. Access the ASFA submission here.
8 May 2012 In the 2012 Federal Budget the Government announces a levy that will be paid by SMSFs to fund the costs to Government, in particular ASIC, in implementing the SMSF auditor registration reforms. See Budget Paper No.2 Part 2 Expense Measures Treasury in particular Stronger Super – self managed superannuation funds auditor registration.
21 May 2012

Treasury releases draft regulations to require:

  • trustees of SMSFs to consider insurance for their members as part of the fund’s investment strategy;
  • money and other assets of an SMSF be kept separate from money and assets held by a trustee personally and by a standard employer-sponsor or an associate of a standard employer sponsor; and
  • SMSFs to value the assets of the fund at net market value for reporting purposes.

Jul 2012 The Government announces delayed starting dates for a number of SMSF reforms.

In summary the following implementation dates have been delayed:

  • The introduction of a new range of administrative penalties (1 July 2013)
  • Powers to require specific contraventions to be rectified (1 July 2013)
  • Mandatory trustee education (1 July 2013)
  • The acquisition and disposal of assets between SMSFs and related parties (1 July 2013)
  • Criminal and civil sanctions to enable the ATO to penalise and discourage illegal early release scheme promoters (on Royal Assent)
  • Amendments to existing tax laws so that amounts illegally released early are taxed at the superannuation non-complying tax rate (1 July 2013)
Jul 2012 The Government releases exposure draft legislation on SMSF Auditor Registration.

6 Aug 2012 On the 6 August 2012, the Superannuation Industry (Supervision) Amendment Regulation 2012 (No. 2) was registered.

This regulation amends the Superannuation Industry (Supervision) Regulations 1994 to:

  • require SMSF trustees, for years 2012–13 and later, to value the assets of the fund at market value for reporting purposes;
  • require SMSF trustees to ‘regularly review’ the fund’s investment strategy;
  • require SMSF trustees to consider insurance for their members as part of the fund’s investment strategy; and
  • provide the ATO with the power to enforce the requirement for SMSF trustees to keep money and other assets of an SMSF separate from those held by a trustee personally.

20 Aug 2012 Exposure draft legislation released by Treasury regarding a number of SMSF reforms.

The exposure drafts cover:

Administrative consequences and Penalties for Trustees of SMSFs
This measure will provide the Commissioner of Taxation (Commissioner) with additional tools and more flexibility to deal with non-compliance with the law. These new tools will be available in conjunction with the Commissioner's existing powers to regulate the SMSF sector. See Treasury website here.

Penalties for Promoters of Illegal Early Release Schemes
This measure will deter promoters of illegal early release schemes from undermining the Government’s retirement policy and harming members in the process. See Treasury website here.

Roll-overs to SMSFs
As part of this measure, roll-overs to SMSFs will be captured as a designated service under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006. See Treasury website here.

19 Sep 2012 Superannuation Laws Amendment (Capital Gains Tax Relief and Other Efficiency Measures) Bill 2012 tabled in Parliament.

The Bill amongst other things –

  • Introduces a registration regime for SMSF auditors

19 Sep 2012 Superannuation Auditor Registration Imposition Bill 2012 tabled in Parliament.

The Bill provides for the imposition of fees relating to approved auditors of SMSFs.

Royal Assent for Superannuation Laws Amendment (Capital Gains Tax Relief and Other Efficiency Measures) Bill 2012.

The bill contains legislation enabling the SMSF auditor registration process.

Income Tax Rates Amendment (Unlawful Payments from Regulated Superannuation Funds) Bill 2012

Tabled in Parliament. The bill imposes the superannuation fund non-complying tax rate of 45% on those amounts that are released early from superannuation by illegal means.

Superannuation Legislation Amendment (Reducing Illegal Early Release and Other Measures) Bill 2012

Tabled in Parliament. This bill introduces civil and criminal sanctions for a person who promotes a scheme that has resulted, or is likely to result, in the illegal early release of superannuation benefits.

Exposure draft of legislation relating to acquisitions and disposals of certain assets between self-managed superannuation funds (SMSFs) and related parties as well as the accompanying explanatory material.

31 Jan 2013 SMSF auditors can apply for registration through the ASIC website. ASIC launches the SMSF Auditor Registration process.
13 Feb 2013 Superannuation Legislation Amendment (Reform of Self-Managed Superannuation Funds Supervisory Levy Arrangements) Bill 2013 tabled in Parliament. The Bill increases the maximum levy payable by a trustee of a self-managed superannuation fund for an income year from $200 to $300, effective from the 2013-14 financial year.
18 Apr 2013 ASIC releases Report 337 SMSFs: Improving the quality of advice given to investor. The report summarises the findings from the first major project undertaken by ASIC’s Self-managed superannuation fund (SMSF) taskforce.

The revised implementation date for the following reforms:

July 2014 Final changes to the SMSF registration process linking the registration process with proof of identity checks, bank account details and a portal to ATO data for verification of details by APRA funds requested to make rollovers to an SMSF.  
July 2014 From this date all APRA-regulated funds must be able to receive contributions in the new format and SMSFs must be able to receive contributions in the new format where the employer is non-associated.  
2016
July 2016 End of transitional period for when investments in collectables and personal use assets held at 30 June 2011 need to comply with new legislative standards introduced in 2011.
